Terms of service
1. Scope and provider These terms govern all contracts concluded via this online store between Kamaljeet Singh, trading as Fixolify, Türkenstraße 4, 13349 Berlin, Germany ("we", "us") and the customer. Terms proposed by the customer do not apply unless we agree to them in writing.
2. Conclusion of contract Product listings are an invitation to purchase, not a binding offer. By clicking the order button you submit a binding offer. The contract is formed when we send an order confirmation or dispatch the goods. An automated acknowledgement of receipt does not constitute acceptance.
3. Prices All prices are final prices in euro. Pursuant to § 19 UStG we do not charge value added tax, and no VAT is shown on our invoices. Shipping is free; no delivery charge is added at checkout.
4. Payment Payment is due on conclusion of the contract, using the methods shown at checkout.
5. Delivery We deliver to the address given by the customer, within Germany and the European Union. Delivery times stated are estimates from dispatch.
6. Retention of title Goods remain our property until payment has been received in full.
7. Right of withdrawal Consumers have a 14-day right of withdrawal as set out in our Refund Policy and on our Right of Withdrawal page.
8. Warranty The statutory warranty provisions of German law apply. Consumers have a two-year warranty period from delivery.
9. Liability We are liable without limitation for damage arising from injury to life, body or health, and for intent and gross negligence. In cases of slight negligence we are liable only for breach of a material contractual obligation, and limited to the foreseeable damage typical for this type of contract.
10. Intellectual property The content of this store, including text, images and design, is protected by copyright. It may not be reproduced or distributed without our written consent.
11. Relationship with Shopify This store is powered by Shopify, which enables us to provide it to you. All sales are made directly with Fixolify. Shopify is not a party to, and is not responsible for, any aspect of sales between you and us.
12. Dispute resolution The European Commission provides an online dispute resolution platform at https://ec.europa.eu/consumers/odr. We are neither willing nor obliged to participate in proceedings before a consumer arbitration board.
13. Governing law and jurisdiction German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. Mandatory consumer protection provisions of the country in which the consumer is habitually resident remain unaffected.
14. Severability Should any provision of these terms be or become invalid, the validity of the remaining provisions is unaffected.
